The TwinFlame Horoscope API - License Agreement

1. Introduction

This API License Agreement (the "Agreement") governs your use of the TwinFlame Horoscope API (the "API"), any associated API Output, and any associated documentation (the "Documentation"). By using the API, you agree to be bound by this Agreement.

2. Definitions

"API" means the TwinFlame Horoscope API, including any associated documentation.
"Documentation" means the documentation provided byTwinFlame Development, LLC for the API, including any updates or changes thereto.
"Intellectual Property Rights" means all patents, copyrights, trademarks, trade secrets, and other intellectual property rights of any kind, whether registered or unregistered, and all applications for such rights.
"User" means any person or entity that uses the API.
“API Output” means the text, graphics, images, logos, sounds, music, videos, and other content that is generated by the API.
“Commercial Use” means any use of the API in a product, service, or solution that generates revenue or has a commercial pursuit. This includes, but is not limited to:
- Use of the API to power a mobile app that provides daily horoscopes.
- Use of the API to power a website that provides horoscopes for different signs.
- Use of the API to provide horoscopes for employees as part of a wellness program.
- Use of the API to provide horoscopes for customers as part of a marketing campaign.
"Non-Commercial Use" means any use of the API that is not for the purpose of generating revenue, including but not limited to:
- Personal use.
- Educational use.
- Research use.

3. Limited License

With subscription to TwinFlame Horoscope API - Non-Commecial:

Subject to your compliance with this Agreement, TwinFlame Development, LLC grants you a limited, non-exclusive, non-transferable, and non-sublicensable license to use the API for Non-Commercial Use.

With subscription to TwinFlame Horoscope API - Commercial:

Subject to your compliance with this Agreement, TwinFlame Development, LLC grants you a limited, non-exclusive, non-transferable, and non-sublicensable license to use the API for Commercial Use.

4. Restrictions

You may not use the API for any of the following purposes:

To create a competing API product or service.
Selling or distributing the API or any part thereof.
Selling or distributing the API Output or any part thereof.
To use the API in a manner that violates any applicable law or regulation.

Maximum Number of Users or Devices and associated API calls:

With subscription to TwinFlame Horoscope API - Non-Commecial:

The maximum number of users or devices that can access the API is 100.
The maximum number of monthly API calls is 1,000.

With subscription to TwinFlame Horoscope API - Commercial:

The maximum number of users or devices that can access the API under the commercial license is unlimited.
The maximum number of monthly API calls under the commercial license is 50,000.

If you need to exceed these limits, please contact TwinFlame Development, LLC.

5. Intellectual Property Rights

All Intellectual Property Rights in and to the API, the Documentation, and the API Output are owned by TwinFlame Development, LLC. You agree not to infringe any Intellectual Property Rights in the API, the Documentation, or the API Output.

6. Indemnity

You agree to indemnify and hold TwinFlame Development, LLC harmless from any and all claims, damages, losses, costs, expenses, and liabilities (including reasonable attorneys' fees) arising out of or in any way connected with your use of the API, including but not limited to any claims arising out of your violation of this Agreement.

7. Disclaimer of Warranties

THE API, THE DOCUMENTATION, AND THE API OUTPUT ARE PROVIDED "AS IS" AND TWINFLAME DEVELOPMENT, LLC MAKES NO WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. TO THE MAXIMUM EXTENT PERMITTED BY LAW, TWINFLAME DEVELOPMENT, LLC SHALL NOT BE LIABLE FOR ANY DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, ARISING OUT OF OR IN ANY WAY RELATED TO THE API, THE DOCUMENTATION, OR THE API OUTPUT, WHETHER BASED ON A THEORY OF CONTRACT, TORT, OR OTHERWISE.

8. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Georgia, USA, without regard to its conflict of laws provisions.

9. Entire Agreement

This Agreement constitutes the entire agreement between you and TwinFlame Development, LLC with respect to your use of the API and supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written.

10. Severability

If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck from this Agreement and the remaining provisions shall remain in full force and effect.

11. Changes to Terms

TwinFlame Development, LLC reserves the right to modify this Agreement at any time. If TwinFlame Development, LLC makes any changes to this Agreement, TwinFlame Development, LLC will post the changes on the www.twinflamedev.com website and will update the "Last Updated" date at the top of this Agreement. Your continued use of the API after TwinFlame Development, LLC has posted changes to this Agreement constitutes your acceptance of such changes.

12. U.S. Legal Compliance

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

13. Termination

Your right to use the API will terminate immediately if you violate any provision of this License Agreement.
